Maricopa County Court-Approved Private Investigators for Indigent Defendants

In Maricopa County, indigent defendants—those unable to afford their own legal representation—have the right to certain resources that help ensure a fair trial. One such resource is the ability to request an investigator, which may even be a private investigator, paid for by the county.

Arizona Rules of Criminal Procedure, Rule 15.9

According to Rule 15.9 of the Arizona Rules of Criminal Procedure, defense attorneys for indigent clients can request funding for investigative services, including private investigators. These services are crucial in building an effective defense, especially when additional evidence or witness interviews are necessary.

Rule 15.9(A)(1) allows the court to order investigative services if it determines they are necessary.

Rule 15.9(B) provides that if a defendant cannot afford the costs of these services, the court can authorize the county to pay for them. The public defender or court-appointed attorney can then hire a private investigator, and the county will cover reasonable fees.

This ensures that all defendants, regardless of financial status, have access to the tools necessary for their defense.
